Then it was moved, That in place of the Retention of a 12th part of Annual Rents allowed by the above Act for a Supply, there be an Allowance granted for Retention of a fixth part of Annual Rents, and after fome Reafoning thereupon, it was put to the Vote, Approve of the Article about the Retention, or Amend, and it was carried Approve: And after fome Amendments, the Act was Voted and Approved.

The next day, the Act for a Supply was touch'd Nov. 9 with the Scepter, by the Lord High Commiflioner Supply in the ufual manner; and the Addreffes of the Burgh granted. of Forfar, Parish of Cambufnethan, Parish of Cambufland, Parish of Kilbryde, Parish of Bothwel, and Parish of Old Munkland, (all againft entring into an Union with England, in the Terms of the Union) having been read, a Propofal was given in, that one Months Cefs, given for the three Frigots, and two Birlings, would not equip and maintain them, confidering their bad condition by ftormy Weather, and confidering the Eftablishment; and that therefore an half Month's Cefs be further granted for their Equipment and Maintainance: Which being read, At for the the fame was order'd to lie upon the Table. Then Security the Act for Security of the True Proteftant Religion and of the Government of the Church, was again read; and upon reading the firft Claufe, it was moved, That there fhould be a particular Enumeration of all the Acts, in favour of the Kirk; and after fome reafoning upon it, the Vote was ftated, Approve of the Claufe as it ftands, or amend and enumerate the Acts, and it was carried Approve. Afterwards the fecond Claufe of the faid Act was read and agreed to, and upon reading the 3d Claufe, it was moved, That an additional Claufe be added, for fecuring the continuance of the Univerfities and Colleges of the Kingdom; and thereupon an Amendment being made in thefe Terms, That the Universities and Colleges in this Kingdom, viz. of St. Andrews, Glasgow, Aberdeen dad Edinburgh, as now Established by Law, fhall contidue within this Kingdom for ever. After fome Debate thereupon, the Vote was put, Approve of the Claute as amended, or not, and it was carried, Approve.

On the 12th of November, the Addreffes of the A. C. Burgh of Cryle, the Parishes of Eaftmunkland, Shotts, Dalfeft and Stenhoufe, South and Western Shire, and, 1706. Burgh of Kirkudbright, all against an Union, in the Terms of the Union, were given in and read. This done, the Parliament proceeded to the farther Confideration of the Act, for Security of the Kirk, &c. and the 4th Claufe was again read, whereupon it was moved, That a Claufe fhould be added in thefe Terms: And that they fhall be capable of any Office Civil or Military, and to receive any Grant or Gift, and to have Command, or Place of Truft from and under the Soveraign, within any Part of Great Britain; and after Debate thereupon, it was put to the Vote, add, or not; and it was carried, not; And the Claufe, as it ftood, was agreed to. Then the 3d and the 4th Claufes being again read, and amended, were likewife agreed to; Whereupon the Act was again read, as alfo the Reprefentation of the Commillion of the general Affembly, and a Vote ftated, Approve of the Act, or not; but before the Vote was put, the Lord Beilhaven gave in a Proteftation in thefe Terms: That he did proteft in his own Name, and in the The Lord "Name of all them that fhould adhere to him, That haven's this Act is no Valid Security to the Church, in proteft. cafe of any Incorporating Union; and that the Church can have no real and Solid Security by any ⚫ manner of Union, by which the Claim of Right is "unhing'd, the Scorch Parliament Incorporated, and the diftinct Soveraignty and Independency of Scotland entirely abolifh'd; which being read, he took Inftruments thereupon; and feveral Members adher'd thereunto. It is to be obferv'd, that when the Claufe was offer'd by the Lord Beilhaven, for Exempting Scotch-men from the Sacramental empting Teft, through all the Dominions of Great Britain, Scots Men thofe who were against the Claufe, faid, it was a from the Thing out of their Power, and not reafonable to Sacramenfuppofe that England would grant. To this it wastal Tft. replied, by thofe of the contrary Party, "That the Defign of an Union was Equality, but this was the greateft Inequality imaginable; for the English were free to poffefs Places in Scotland, without any fuch Impofition, but the Scots were excluded from Places in England, without taking the fald Tuft

and that tho' the English thought the Teft a good Security for their Church, it was not reasonable that the Scots, being a part of the fame United Kingdom, and oblig'd to maintain the Presbyterian Government in Scotland, fhould therefore be ex'cluded from the Prince's Favour in any part of the United Kingdom. Two Days after, the Addreffes for the Parishes of Covingtone, Carftaires, Symingtone, Livertofte, Quothquoan, Dunfyre, Ruthergten and Carnwath; and of the Shire of Lenrek, all against allowing an Union with England, in the Terms of the Articles, were given in, and read: After which the fecond Article of Union was again read. Hereupon a Motion was made, That before any Vote upon the faid Article be agreed, it be inferted in the Minutes as a Preliminary, That the agreeing to the fecond Article of the Treaty, in relation to the Succeffion to the Crown of Great Britain, fhall not be binding, or have any effect, unless Terms and Conditions of an Union of the two Kingdoms be finally Adjusted and Concluded, and an Act past thereupon in this Parliament; and that the faid Terms and Condi tions be alfo agreed to, and ratify'd by an Act of the Parliament of England. A Refolve was alfo given in, That the Houfe would procced to the confideration of the Articles of the Treaty, which relate to Trade and Taxes. After fome Debate thereupon, the Vote was ftated, Proceed to the confideration of the fecond Article of Union in the Terms of the Motions, or proceed to the Confideration of the 4th, and other Articles of the Treaty, which relate to Trade and Taxes, and it was carried proceed to the fecond, by a Majority of 110 Voices, against 84.

Then the Addrefs of Glafgow, Gerbals and Mure, Biggar, and Shire of Lanerk, against an Incorporating Union, were read; after Debates which the fecond Article of the Treaty was alfo about the read, and it was moved, That the Parliament fhould proceed to fettle the Succeffion upon Regulations and Li-f Union. mitations in the Terms of the Refolve mention'd in the Minutes of the 4th of November, and not in the Terms of the fecond Article of Union. It was moved alfo, to addrefs Her Majefty, and to lay before her the Condi tion of the Nation, and the Averfion in many Perfons to an Incorporating Union with England, and to ac quaint Her Majefty with the Willingness to fettle the Succeffion in the Proteftant Line upon Limitations, and in order thereto, that fome Recefs be granted. After fome Debate on thefe Motions, a Vote was propos'd, approve of the fecond Article of Union, in Terms of the Preliminary Motion, or not, and after fome further Debate, there was a fecond State offer'd, Addrefs, or not. Then it was put to the Vote, whe ther the firft, or fecond, fhould be the State of the Vote, and it was carried the firft; but it being mov'd, that fome further Reasoning fhould be allow'd before the Vote, after fome Debate, it was agreed, that the English Acts of Parliament mention'd in the fecond Article of Union be read; and that immediately after a Vote fhould be ftated, proceed to call the Vote, or delay. Accordingly the faid English Acts of Parliament were read, and thereupon the Vote was stated, proceed to call the Vote for approving the fecond Article, or delay, and it was carried proceed. Then the Vote was put, approve the second Article in the Terms of the Preliminary, Motion, Yea, or No. But before Voting, The Earl the Earl Marifchal gave in a Proteft for himself, and Marifall those who should adhere to his Proteftation, That no chal's ProPerfon could be defign'd a Succeffor to the Crown of that teft. Realm, after the Deceafe of Her Majefty, whom God long preferve, and failing fue of her Body, who wa Succeffor to the Crown of England, unless that in the prefent Seffion of Parliament, or any other Seffion of this,

A.C. or any enfuing Parliament during Her Majefty's Reign 1706. there be fuch Conditions of Government fetled and enacted, as might fecure the Honour and Soveraignty of that Crown and Kingdom, the Frequency and Power of Parliament; the Religion, Liberty and Trade of the Nation from England, or any Foreign Influence, which being read, he took Inftruments thereon. And it was agreed, that a Lift of the Members should be printed, as they Voted, approve, or not, and that they who adher'd to the Proteft, fhould be mark'd. Then the Vote was put, approve, or not, and it was carried Approve, by 59 Votes; and at calling the Rolls the Viscount of Stormount adhered to the Earl Marifchal's Proteft.

Three Days after, the Addrefs of the Burgh of Kirckenbright, Parish of Crawford, Burgh of Cauper in Fyfe, Presbytery of Lanerk, Town of Lanerk, and Parish of Crawford's John, all against an Incorporating The 3d Ar-Union were read; and then the third Article of the ticle deba- Treaty of Union was again read, whereupon it was mov'd, That the agreeing to the faid Article, in relation to the Parliament of Great Britain, fhould not be binding, nor have any effect, unlefs Terms and Conditions of an Union of the two Kingdoms, and particularly the Conftitution of the Said Parliament, be finally adjusted and concluded, and an Act past thereupon in the Parliament; and that the faid Terms and Conditions be alfo agreed to, and ratify'd by an Act of the Parliament of England, the Conftitution of the Parliament of Great Britain being left intire, until the Parliament come upon the 22d Article. It was mov'd alfo, to proceed to the Confideration of the fourth, and other Articles of Union, before the third, and after fome Reasoning thereupon, it was put to the Vote, proceed to the Confideration of the third Article, in the Terms of the Motion relating thereto, or proceed to the fourth Article, and it was carried proceed to the third. Accordingly the Parliament proceeded to the Confideration of the third Article; and after long Debate thereupon, a Vote was stated, Approve of the third Article, in the Terms of the Motion relating thereto, or The Mar- not, But before voting, the Marquis of Annandale, quis of An- gave in a Proteft, and defired that the Narrative of nandale's the Refolve inferted in the Minute of the 4th of that Proteft.
