1. TRUSTS ($99*)-CONSTRUCTIVE TRUSTS-
BREACH OF ORAL AGREEMENT.

Even if plaintiff agreed orally to purchase
certain lands for interveners and himself, no
trust arose in favor of interveners on plaintiff's
purchase of the land in his own name, where
the agreement was without consideration, the
interveners furnishing no money for the pur-
chase, and they could have purchased for them-
selves.
